Can I end my lease early if I leave Korea or move for work?

Not on your own, unless your contract or the law gives you a way out. Your fixed term keeps running even when your visa expires, a job takes you to another city or you decide to go home. There are three exits. Your contract may contain an early termination clause. Your lease may already be in an automatic or requested renewal, which you can end at any time with 3 months' notice. Or the landlord may agree to let you go, usually in return for help finding the next tenant and paying the broker. Until one of these applies, you can still owe rent, and the landlord can take unpaid rent out of your deposit.

Does my visa or job ending cancel the contract?

No. Korean law treats a lease as a promise for the agreed period, whatever happens to the tenant's stay. The few situations in which a tenant may walk away on their own are about the home, not the tenant: for example, part of the flat is destroyed without your fault and what remains cannot serve as a home, or the landlord's works make living there impossible. A workplace change, the end of a degree or an E-7 contract that is not extended does not fall into that group.

That does not mean you are stuck. It means the timing and cost of leaving depend on which kind of lease you have.

Which kind of lease do I have?

Your leaseHow you can leaveWhen it ends
Original term, with a clause allowing early termination (중도해지 특약)Give notice under the clauseOne month from the day the landlord gets your notice, under the Civil Act, unless the clause is kinder to you
Renewed automatically (묵시적 갱신) because neither side objected in timeGive notice whenever you likeThree months from the day your notice reaches the landlord
Renewed because you used your renewal requestNotice at any time, as in the row aboveAlso three months from delivery
Original term, no clauseOnly by agreement with the landlordOn the date you both sign

A clause that demands more than a month's notice from the tenant, or a large penalty for leaving, may not bind you in full. Have it read before you rely on it or pay it.

How do I negotiate an early exit?

Most early departures end in a deal. The landlord wants the rent to keep coming; you want your deposit and a clear end date. Raise it as soon as you know you will go, not two weeks before the flight.

  • Propose a date. Offer a move-out day and say whether you can stay until a new tenant is found.
  • Help with the search. Allow viewings at agreed times, and list the flat with brokers near the building.
  • Settle the broker's fee (중개보수). By custom, a tenant who leaves early often pays the fee for finding the replacement. This is a matter of agreement, not a rule, so put the amount in writing.
  • Fix the money. Write down who pays rent and the maintenance fee until the handover, and the day the deposit comes back.
  • Use both languages. Sign a short termination agreement in Korean, with a translation beside it, and keep a copy each.

Can a friend take over my room instead?

Not without the landlord's consent. Handing the flat to a friend or a colleague from your country without permission is a transfer or sublet the landlord can treat as a reason to end the lease. It also leaves you responsible for whatever that person does. If the landlord agrees, record the consent in writing, and make clear whether the new person is signing a new lease or simply living in yours.

What can the landlord claim if I simply leave?

If you move out without an agreed exit, the lease does not end on the day you go. The landlord may claim the rent for the remaining period, or the loss up to the point a new tenant moves in, and deduct it from the deposit. Where the contract sets a penalty (위약금), Korean law presumes it is a pre-agreed figure for damages, and a court can lower it if it is unfairly high. What the landlord cannot do is keep the whole deposit as a punishment when the real loss is far smaller.

What happens to my deposit if I leave before it is paid back?

Your protection against a sale or auction of the home relies on you living there with your address registered. If you move your residence report to a new city while the old deposit is still unpaid, that protection can end. A court lease registration is available only after the lease has ended, which is another reason to get the end date fixed in writing first. Leaving for good adds one more risk: your registration card goes back to the officer at the border, and the record of your stay can then be closed. Settle the deposit, or secure it on the registry, before your departure date.

What is my checklist for the final weeks?

  • Send your notice or termination request in writing and keep proof the landlord received it.
  • Count the end date: 1 month or 3 months from receipt, or the date in your agreement.
  • Agree the handover inspection and the deductions in writing.
  • Give an overseas account for the deposit, plus a backup.
  • Sign a power of attorney (위임장) for someone in Korea if the money will be paid after you leave.
  • Keep your Korean phone number or messenger account active until the last won arrives.

Next step

Find your contract and check two things: whether it has an early termination clause, and whether the lease has already been renewed once. Then send your notice or proposal in writing. If the landlord refuses to talk, demands a large penalty or keeps the deposit after you have gone, we can step in for you. Consultations are paid; when you contact us, a staff member will call you back and explain the fee.
